SMS Messaging Privacy Notice

Effective date: September 18, 2026

Daymark Recovery Services, Inc. (“Daymark Recovery Services,” “we,” “us,” or “our”) provides text-messaging programs for secure document notifications and staff operational alerts. This notice explains how we collect, use, disclose, and protect information associated with those programs.

This notice applies specifically to Daymark Recovery Services text messaging. Other information processed through Daymark Recovery Services websites, clinical systems, employee systems, or the authenticated DRS_IS application may be subject to additional privacy notices, policies, employment practices, and legal requirements.

1. Our text-messaging programs

Daymark Recovery Services operates the following text-messaging programs:

Secure Document Links. Daymark Recovery Services may send a recipient a generic notification containing a private, time-limited link to a secure document portal. The recipient may be required to verify their identity before viewing or signing a document.

The text message does not contain the document itself. Information available after authentication may include patient, clinical, employment, or other sensitive information and is protected separately within Daymark Recovery Services’s secured systems.

Staff Operational Alerts. Daymark Recovery Services employees may voluntarily enroll in recurring operational alerts concerning subjects such as facility closures, severe weather, system outages, and staffing or coverage needs.

Staff Operational Alert message bodies are intended for operational information and are not to include client or patient information, clinical or treatment information, or sensitive personnel details.

2. Information we collect

Depending on the program, we may collect and maintain:

  • Your name or internal user identifier;
  • Your mobile telephone number;
  • Your relationship to Daymark Recovery Services, such as patient, employee, or authorized recipient;
  • The messaging program and alert groups you selected;
  • The date, time, source, and wording associated with your consent;
  • Telephone-number verification records;
  • Opt-in, opt-out, and subscription-change history;
  • Message identifiers, transmission status, delivery status, and failure information;
  • HELP, STOP, and other supported messaging requests;
  • Security, fraud-prevention, troubleshooting, and audit information; and
  • Information needed to comply with legal, regulatory, carrier, and recordkeeping requirements.

Daymark Recovery Services’s authenticated systems may separately maintain clinical information, protected health information, employment records, documents, electronic signatures, or other sensitive data. This SMS notice does not represent that Daymark Recovery Services does not collect or maintain those categories of information.

3. How we use messaging information

We may use messaging information to:

  • Confirm and document consent;
  • Verify control of a mobile telephone number;
  • Deliver secure document notifications or operational alerts;
  • Manage program and alert-group subscriptions;
  • Process and honor HELP and STOP requests;
  • Prevent unauthorized, abusive, or fraudulent messaging activity;
  • Monitor delivery, diagnose failures, and provide support;
  • Maintain security and audit records;
  • Comply with applicable laws, carrier requirements, and contractual obligations; and
  • Protect the rights, safety, and security of Daymark Recovery Services, its workforce, patients, recipients, and systems.

We do not use Staff Operational Alerts to send advertising or third-party marketing.

4. Sensitive information and SMS

SMS is not end-to-end encrypted. Messages are transmitted through mobile carriers and other telecommunications providers outside Daymark Recovery Services’s direct control.

Daymark Recovery Services’s policy is not to place protected health information, clinical details, treatment information, client or patient identifiers, passwords, financial information, or sensitive personnel information in SMS message bodies.

A Secure Document Link message may contain a generic notice and a private, time-limited link. Sensitive information available after opening that link remains within Daymark Recovery Services’s secured application and may require identity verification before access.

Recipients should not send medical, clinical, financial, password, or other sensitive information by replying to a Daymark Recovery Services text message.

5. Disclosure to service providers

Daymark Recovery Services does not sell mobile telephone numbers, messaging information, or text-message consent records.

Mobile information will not be shared with third parties or affiliates for their own marketing or promotional purposes. Text-messaging opt-in data and consent will not be shared with third parties or affiliates for their own independent purposes.

Daymark Recovery Services may provide limited messaging information to service providers acting on Daymark Recovery Services’s behalf when necessary to operate, secure, support, and deliver the messaging programs. These providers may include Amazon Web Services, telecommunications aggregators, mobile carriers, security providers, and technical-support providers.

We may also disclose information when required by law, legal process, regulatory obligation, or when reasonably necessary to protect the security, rights, or safety of Daymark Recovery Services or others.

Service providers are permitted to use the information only for the services they provide to Daymark Recovery Services or as required by law. They are not authorized by Daymark Recovery Services to use text-message opt-in data for their own marketing.

6. Consent and choices

Participation in a Daymark Recovery Services text-messaging program requires consent appropriate to that program.

You may reply STOP to a message to stop future messages from the number that sent it. Because Secure Document Links and Staff Operational Alerts use separate sending numbers, opting out of one program does not necessarily opt you out of the other.

Employees may also manage individual Staff Operational Alert groups through their authenticated Daymark Recovery Services account.

Reply HELP for assistance. Message and data rates may apply, and message frequency varies.

Additional program details are available in our SMS Terms and Conditions.

7. Retention

Daymark Recovery Services retains messaging records for as long as reasonably necessary to operate the applicable program, document consent and opt-out requests, investigate delivery or security issues, meet legal or regulatory obligations, and enforce Daymark Recovery Services policies.

Retention periods may vary based on the type of record and the program involved. Expired telephone-verification codes and similar temporary security data may be deleted sooner than consent, opt-out, delivery, and audit records.

8. Security

Daymark Recovery Services uses administrative, technical, and physical safeguards designed to protect messaging records. These measures may include access restrictions, authentication, encryption within supported systems, activity logging, monitoring, and workforce policies.

No system or transmission method can be guaranteed to be completely secure. SMS messages are not end-to-end encrypted after they leave Daymark Recovery Services’s and its service providers’ protected systems.

9. Corrections and questions

You may contact Daymark Recovery Services to ask questions about its text-messaging programs, request correction of messaging contact information, or obtain assistance with your messaging preferences.
